Copyright Policy

Operator: Hopgate VPN (“we”, “us”, “our”)
1. General Statement
Hopgate VPN respects intellectual property rights and does not condone copyright infringement. As a virtual private network provider, we operate solely as a passive intermediary and have no access to user content, browsing history, or traffic logs that could identify or track any alleged infringement.
Hopgate VPN is not subject to the U.S. Digital Millennium Copyright Act (DMCA) or any equivalent foreign legal regime. However, in accordance with international good-faith standards, we may voluntarily review legitimate copyright infringement notices and take action only when technically and legally feasible under the laws of the Republic of Seychelles.
2. Legal Status and Compliance
- Hopgate VPN is operated by an International Business Company (IBC) governed exclusively by the laws of the Republic of Seychelles.
- We are not a hosting provider and do not store, distribute, or control user-generated content.
- We implement strong encryption and a strict minimal-log policy: only transient signup IP addresses, bandwidth usage, and basic payment metadata are processed for operational purposes.
- We are technically unable to monitor, inspect, or filter user traffic.
Accordingly, our role is strictly limited to voluntary review of notices and taking action only when feasible and legally required under Seychelles jurisdiction.
3. User Responsibility
Users agree not to use the Service to violate intellectual property rights, including downloading or sharing pirated or unauthorized copyrighted material.
Prohibited activities include:
- Unauthorized distribution or transmission of copyrighted works
- Peer-to-peer (P2P) or torrent usage for the purpose of sharing or obtaining copyrighted content without authorization
- Using the Service to bypass geo-restrictions for unlawful access to copyrighted content
Any violation may result in suspension or termination of access to the Service.
4. Submitting a Copyright Notice
If you believe your intellectual property rights have been infringed by a person using Hopgate VPN, you may submit a notice to support@hopgate.net.
To be considered, your notice must include:
- Your full name and contact information
- Proof of ownership or authorization to act on behalf of the rights holder
- A clear description of the copyrighted material allegedly infringed
- Evidence supporting your claim linking the activity to our Service
- A statement made in good faith affirming the accuracy of the claim
- An electronic or physical signature
Important: Due to our no-activity-log policy and encrypted infrastructure, we cannot identify users, provide traffic records, or block specific content. We may, however, take limited good-faith measures such as reviewing aggregated network patterns or restricting access if abuse is verifiably linked to a specific account.
5. Limitations and Scope of Responsibility
Hopgate VPN provides encrypted network access and does not control third-party content. Specifically, the Service:
- Does not host or distribute copyrighted or infringing content
- Does not index, monitor, log, or track user activity
- Does not have the technical capability to remove third-party content or block access to external websites
Hopgate VPN cannot be held responsible for content transmitted through third-party networks not operated by the Company.
6. Voluntary Good-Faith Cooperation
Although we are not legally obligated under any foreign copyright regime, we may, at our discretion and only when technically feasible, take limited actions to address confirmed abuse, including:
- Issuing a warning to an identifiable account
- Restricting or disabling Service access in cases of repeated or substantiated violations
- Implementing technical measures to prevent further misuse of the network
These measures exist solely to protect the integrity of the Service and to ensure responsible usage, without compromising our core commitment to user privacy and encryption.
7. Policy Updates
We may amend this Policy to reflect changes in operational requirements, Seychelles law, or international best practices. The effective date will be updated accordingly.
8. Legal Correspondence and Jurisdiction
Hopgate VPN is operated by an International Business Company (IBC) incorporated under the laws of the Republic of Seychelles. Due to the privacy-focused nature of the Service, the Company does not maintain a publicly accessible physical office address.
All legal, administrative, or regulatory correspondence must be directed exclusively to legal@hopgate.net. Any legal notices shall be deemed properly delivered once sent to this email address, unless otherwise required under the applicable laws of the Republic of Seychelles.
